1. General Information
- The online platform prsolutions.pl and its associated media monitoring application are operated by PRS Group Andrzej Sowula, located at 30/3 Wodna, 30-719 Kraków, Poland, entered into the register of business activity conducted by the Mayor of Krakow under the registration number: 913/2004; tax identification number: PL813-288-79-49; REGON: 691757972, hereinafter referred to as the “Service Provider” or “We”.
- PRS Solutions provides public relations services and media monitoring tools via the Internet.
2. Scope of Services
- The Service Provider offers the following services:
- Media monitoring and analysis
- PR campaign management and reporting
- Press release distribution
- Media relations development
- Crisis communications management
- Communications strategy consulting
- Access to the media monitoring application
- The media monitoring application allows users to:
- Track mentions of selected keywords, brands, or individuals across various media platforms
- Generate analytical reports and insights
- Set up alerts for specific media coverage
- Archive and organize media mentions
- Export data for reporting purposes
3. Service Orders and Contracts
- Orders for services are accepted via the Internet, telephone, or in-person meetings. To place an order online, you must complete the order form. After placing an order, you shall be sent an e-mail message confirming that the order was received by the Service Provider.
- A contract between you and the Service Provider is confirmed by clicking the “Confirm Order” button for online services or by signing a service agreement for custom PR services. For the media monitoring application, the contract is confirmed upon account creation and acceptance of these terms.
- The contract covers the specific services mentioned in the order. The rights and obligations of the parties arising from the contract are governed by the Polish Civil Code of 23 April 1964 (Journal of Laws of 1964. No. 16, Item 93, as amended) and the Polish Consumer Rights Act of 30 May 2014.
- The service agreement is concluded in accordance with Polish law.
4. Legal Jurisdiction
- The competent court for any disputes arising from the service agreement is the court competent for the defendant or the court competent for the place of performance of the agreement.
5. Service Availability
- Should any services covered by the contract be temporarily unavailable, you shall be immediately informed about that fact. You shall then decide whether the contract is to be executed partially, postponed, or completely cancelled.
- The Service Provider reserves the right to limit access to certain premium features of the media monitoring application based on the selected subscription plan.
6. Pricing and Subscription Plans
- All prices are given in Euros and include VAT. The price of each service package is binding at the time the Client places an order. The Service Provider reserves the right to change prices of services on offer, introduce new services to its offer, carry out and cancel promotional actions, or make changes in them.
- The media monitoring application is available in several subscription plans with different feature sets and monitoring capabilities. Detailed pricing information is available on the prsolutions.pl website.
- The Client can pay for the ordered services using one of the following forms of payment:
- Via bank transfer to the Service Provider’s account
- Via PayPal
- Via credit card payment
7. Data Protection and Privacy
- Personal information provided during registration or in the order form is collected and processed in accordance with the General Data Protection Regulation (GDPR) and the Polish Personal Data Protection Act. The collected personal data is used only for the purposes of carrying out service agreements, providing access to the media monitoring application, and to inform about promotional activities. In no case will it be shared with unauthorized third parties.
- Every client has the right to access, modify, and delete their personal information from our database. For more information, please refer to our Privacy Policy available on the prsolutions.pl website.
- The media monitoring application processes public information available in media sources. The Service Provider is not responsible for the content of monitored media or the accuracy of information contained therein.
8. Intellectual Property
- All content, features, and functionality of the media monitoring application, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of the Service Provider or its content suppliers and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
- Clients may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the application, except as generally required for normal platform usage.
- Reports, analyses, and other materials created by the Service Provider as part of PR services are licensed to the Client for their internal business use only, unless otherwise specified in writing.
9. Service Delivery and Account Access
- Upon subscription to the media monitoring application, the Client will receive access credentials via email within 24 hours of payment confirmation.
- PR services will be delivered according to the timeline specified in the service agreement.
- The Service Provider reserves the right to suspend or terminate account access in case of payment default or violation of these Terms of Service.
10. Cancellation and Refunds
- The Client may cancel subscription to the media monitoring application at any time by notifying the Service Provider via email at info@prsolutions.pl. The subscription will remain active until the end of the current billing period.
- For PR services, the Client may cancel the service agreement within 14 days of its conclusion, provided that no work has been performed. If work has already been performed, the Client shall pay for the services rendered up to the date of cancellation.
- We shall reimburse all applicable payments received from the Client according to the cancellation policy specified in the service agreement.
- To process your refund, we require confirmation of the original payment method. Once your cancellation request is processed, we shall send you an email to notify you of the approval or rejection of your refund.
- If approved, your refund shall be processed and credit will automatically be applied to your original method of payment within a specified number of days, depending on your financial institution’s policies.
11. Complaints
- If you are dissatisfied with our services or encounter issues with the media monitoring application, you should send a complaint to info@prsolutions.pl or mail a complaint letter to our physical address: PRS Solutions, Wodna 30/3, 30-719 Krakow, Poland.
- The correct complaint should contain at least the following:
- Your name, address, and e-mail address
- The date of conclusion of the agreement giving rise to the complaint
- The subject of the complaint, indicating your request
- All the circumstances justifying the complaint
- Screenshots or other evidence if the complaint concerns the media monitoring application
- If the data provided in the complaint needs to be supplemented, before examining the complaint, we shall ask you to provide additional information within a specified time limit.
- We shall consider the complaint within 14 days of its receipt in the correct form. The response to the complaint shall be sent to the specified e-mail or traditional mail address.
- In the case of justified complaints regarding the media monitoring application, we may offer:
- Fixing the identified issue
- Extending the subscription period as compensation
- Partial refund for the period of service disruption
- Other remedies as appropriate to the situation
12. Limitations of Liability
- The Service Provider shall not be liable for:
- Temporary unavailability of media sources outside our control
- Accuracy or completeness of information provided by monitored media sources
- Business decisions made by the Client based on media monitoring data
- Indirect, consequential, or incidental damages arising from the use of our services
- Service interruptions due to force majeure events
- The total liability of the Service Provider for any claims related to the services shall not exceed the amount paid by the Client for the relevant services during the 12 months preceding the claim.
13. Modification of Terms
- The Service Provider reserves the right to modify these Terms of Service at any time. Changes will be communicated to Clients via email and/or notification on the prsolutions.pl website.
- Continued use of the services after such modifications constitutes acceptance of the updated Terms of Service.
14. Final Provisions
- These Terms of Service constitute the entire agreement between the Client and the Service Provider regarding the use of PR services and the media monitoring application.
- If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
